Cody Davis Obituary

Published by Legacy Remembers on Jan. 9, 2017.

Cody Fowler Davis lived his life and raised his children according to an important mantra: “Salt water cures everything.” This included bumps and bruises, a grumpy attitude, daughters’ broken hearts from failed high school relationships, and even a deep wound in his back caused from falling on his deep sea spear gun. Cody grew up fishing and boating around Davis Island and the Hillsborough River with his brother, Jim Davis and sister, Kimberly Davis Rehyer. He attended Jesuit High School, and was as an all-American tennis player. He headed inland to play tennis for Vanderbilt University, where he was their #1 player.

He met his wife, Beth, as a sophomore at Vanderbilt. He offered to purchase her meal tickets off of her after seeing her poster in the cafeteria, but his check bounced (which may have been intentional), so Beth had to seek him out across campus. They were married four years later in 1983, while Cody was attending the College of Law at Florida State University.

Cody began his career at MacFarlane & Ferguson in Tampa and became the youngest partner in the history of their firm. He subsequently founded several firms: Davis & Scarritt, Davis & Harmon, and, most recently, Cody Fowler Davis Trial Attorneys. Cody was one of the few attorneys in Florida board certified by the Florida Bar in both civil trial law and business litigation. He was also a certified circuit court mediator and federal court mediator. Recently, Cody was voted the #1 lawyer in Tampa Bay by his peers for plaintiff’s personal injury litigation and insurance law.

Cody was a long-time board member at Berkeley Preparatory School, the Hillsborough County Bar Association, Tampa General Hospital, the Tampa Yacht and Country Club, the University Club, and Useppa Island. Most importantly, he continued to beat his peers and much younger players every Monday night at the Tampa Yacht Club tennis league. Cody and his wife Beth were a critical part of the founding team of the Akilah Institute, a women’s college in Rwanda, and the first supporter of the organization. For many years, he provided his Tampa office as the U.S. office for the Akilah Institute and loved joining in on event planning and strategy meetings. He was an award-winning author of two legal thrillers: “Green 61” and “Implied Consent” and had outlined a third novel.

His favorite place on earth was Useppa Island in southwest Florida. He spent most weekends there with Beth and their four daughters, Elizabeth Hughes (32), Mary-Patton Davis (28), Caroline Davis (25), and Cody Davis (21). His daughters were raised on the beaches of Useppa and Cayo Costa, where they learned important life skills including snook fishing, scuba diving, and lobstering. His tutelage efforts expanded to include his granddaughters, Lorraine and Tamsyn Hughes, who were holding fishing rods as soon as they were old enough to walk.

Cody left us on the evening of Friday, January 6, 2017 after suffering a massive heart attack in his home in Tampa. He had just finished doing what he loved – playing racquetball with friends– after having spent two weeks with the whole family on Useppa, helping organize a surprise engagement for Mary-Patton to her fiancé, Matt Eisen, and getting deep satisfaction from beating his sons-in-law, Dave Hughes and Brennan Smith, in bocce ball. He will be missed dearly.

The funeral service will be held at 1pm on Friday, January 13th at St. John's Episcopal Church in Hyde Park of South Tampa.

In lieu of sending flowers, please consider contributing in Cody’s name to one of the following initiatives:

Cody and I were like brothers at Jesuit. Never did I (or he) have a plan of adventure and mischief that was not enthusiastically received by the other. Tennis, water-skiing, teasing Carol Warabee and Coach Debanardo, or studying Latin together. Junior year, we both did tons of extra Calculus and advanced math (even for Jesuit High) competing to be the number one at math.

Last time I spent a day with Cody, was water skiing on the Hillsborough river, upstream of the dam.
Barbecue, skiing loud outdoor music and meeting Beth for the first time. I did not learn of his death, until some time afterwards. I still grieve the lost of one of my dearest friend. As kids at Jesuit, we ran hard and fast, and got into many a scuffle with the other lads, but Cody always had my back, always. That was Cody's gift; he made everyone feel special and important.

Cody save my ash, on many, many legal issues. Being a brilliant, trail blazing engineer, does not translate into the swiftest of business decisions. Cody, would get mad at me, if I did not bring my problems to him, even decades after our teenage years as best friends. Dam this hurts, but after a few years, I feel the need to share with folks, just how wonderful Cody really was and is. I'm sure he is having a wonderful time, with wings, in heaven now.

I deeply miss him until this day.

I just learned of Cody's passing and am very grieved. What a phenomenal human being who lived life to the fullest! I was not a good friend but my dad, Jim Wood, and Cody were good buddies and tennis partners. My dad always bragged that he was the oldest person ever to win the #1 Shoe Match at age 70; and obviously Cody was his partner.

The one thing we have in common is our motto, "saltwater cures everything". Cody will be sorely missed and his life is an example for others to follow. I know he is in heaven now.

I could not help but stop to talk to him every chance I had. His heart was as pure as they come and he saw the good in everyone. It seems as though he was born to be a father and grandfather. I am truly blessed to have know Cody and I will think of him often while sipping his favorite "chocolate mudslide" on Useppa.

yes, I was also raised with the old florida belief that salt water cures everything... except maybe a broken heart?

Cody and I were good friends at Vanderbilt. We were fraternity brothers, and we played on the tennis team together. He was one of a kind: a unique combination of warmth, humor, compassion, and intelligence. He was competitive, but he always realized you were playing a game and would buy you a beer afterwards and laugh about the game whatever the result was. I'll miss him. Sorely.

I will always admire Cody Davis style of play . He and I won 3 mixed double. Titles! HIAC AND TYC ! He was not only had a unique sense of play but always portrayed a stellar style in sportsmanship ! He not only taught me perfecto positioning but how to develop a innate instinct of where the tennis ball would be and I would follow his lead wherever. He always had a grin of joy when that match point was Won !!He iconic sense of play coupled with a great attitude will prevail on the Tampa town courts forever god bless his family

Harry Lee Coe, IV

Having known Cody for virtually all of my life (Davis Islands tennis courts, etc.) and having joined him later in the legal field, my perspective of his life was indeed wide. Cody was a real 'doer' in life- whether that was his family, his community, his church, or his profession. Cody was a consummate professional and truly a wonderful, colorful, unique, and irreplaceable human being. While far too short, he accomplished much of what he wanted and set out to, in life, and did it with grace, class, and with a smile on his face. Cody's light burnt bright and he will be sorely missed. Our thoughts and prayers are with his family during this difficult time. Harry Lee Coe, IV, Esq.

wow, a little shocked at the news of the passing of my classmate Cody. I had the priviledge of playing tennis against him at Jesuit where we attended high school together. I had been a supporter if his brother Jim in his run for the gov. of Fla., but hadn't seen Cody in a long time. by the obit written, it seems to me he will be dearly missed by many people. we never know when the Lord calls us home, i'm just glad to read that he had spent much valuable time with his family. all that's left r the memories. rest in peace my Jesuit '77 friend! Michael Angel Lezcano

January 11, 2017

Tom Scarritt

I met Cody at FSU Law School, where we became tennis buddies and served together on the FSU Student Supreme (Honor) Court. He introduced me to his brother Jim and Peggy, some of our dearest friends. When Cody and I approached 40,we decided that we didn't want the red convertible or the mistress so we broke off from our big law firms and started Davis and Scarritt, which became very successful quickly. We had more fun trying cases and practicing law together during that time than most lawyers know in a lifetime.I thought of myself as an accomplished prankster, but I learned than Cody and Jim were in a league of their own. When Cody was "on", (which was most of the time) there was no one more charming, kind, and generous. Setting staff salaries with him was a nightmare because he always wanted to give away the farm. He could persuade anyone, like when he convinced me (in 30 minutes) to become a YMKG Pirate. He was a consummate trial lawyer and superb tennis player. I am honored to call him my friend, classmate, tennis partner, Pirate mentor, and law partner. There is a gaping black hole in my heart, which breaks especially for Beth, the love of his life, and his beloved girls, all of whom he adored. I love and miss you Cody, my bro.

Condolences from the Loeb's who currently reside in the Davis family's previous home in Hyde Park. While our interactions with Cody were brief, his energy truly shined in those moments. When the house was changing hands, Cody made it known how many memories were made here with his family. He was so eager to show us all the nooks and crannies and the way it had been renovated over the years, energetically going room by room with stories. I will never forget that. We wish you peace and strength during this difficult time. Sincerely, The Loeb Family

The calendar book read: "Play Date with Cody Davis." We both showed up in diapers....and a handsome photograph it made. That was a short 56 years ago....
Cody was that extremely rare blend of super nice guy and tenacious brilliance. He always tried to do right by others; and held true to his moral compass and beliefs. Cody was a good man, and to my good fortune, my first friend.
Into God's hands way too soon pal. Our family's heartfelt thoughts and prayers...

Cody we will miss you.Our hearts and prayers go out to Beth and the girls for your loss. I was shocked when I heard this. Cody and Jim grew up on Davis Island with us, playing tennis. We used to carpool Cody to Jesuit. He was "Cool Cody", our class president. We'd run into each other around Tampa and pick up a conversation like it was yesterday in high school. I'm sorry to lose my friend. I look at what he has accomplished and his legacy and I know he lived a full life. God Bless you Cody.

Dick Coley

I was shocked when my son Tagg told me Cody had a massive heart attack the other day. I am even more shocked to realize that it was Friday night because he and I stopped each other at Harbour Island AC right after he finished playing racquetball and shook hands and joked about his Crimson HARVARD shirt which he said his cost him two tuitions and mine was an old Harvard Hockey tee shirt from my college days. I cannot believe he then died that night. On behalf of our family, my sincere condolences to all of the Davis Family.

Moving to Tampa at the end of 1973, I was able to follow Cody's progress in tennis as a junior, highschooler, college standout, and top-notch adult competitor. I also followed his racquetball career starting at Harbour Island. And, we discussed legal issues throughout his law career. Playing sports with Cody was always a delight because of the give and take in good-natured needling. He was an enviable example to all as both a good winner and a good loser, although he didn't lose too much at anything. He always had the time for a hello and a brief chat. My deepest condolences to his family and I hope these written remembrances and reflections by his friends and fellow competitors will put a smile on his family's faces.

Cody and I started our law careers together at Macfarlane, Ferguson, Allison & Kelly almost 33 years ago. We sweated out waiting for our Bar Exam results. We were the 'newbies' there and then Jim Goodwin, Matt Foster, Tony Black and Gordon Schiff came along. A great bunch and Cody was the most brazen of the lot (which we attributed to his feeling safe becasue Chester Ferguson was his Godfather). A GREAT guy, married a Great gal, and raised a bunch of Great daughters: gorgeous, intelligent, and with his and Beth's spirit in them, and of whom he was (and always will be) Sooooooo PROUD. Very sad to hear he's passed.

I am so very saddened by the loss of Cody Davis. We shared the same love of tennis and Useppa Island and often, when we were there at the same time, he took every advantage of running me all over the court! He had real knack for putting the ball exactly where he wanted and where I was not! Kind, thoughtful, intelligent, humorous; Cody was truly one of a kind and I wish I could have had him for a doubles partner, at least once. I will miss him. My sincerest condolences to the entire Davis Family.

So sorry to hear of the loss of one of my Jesuit classmates. Although we didn't have a lot of interaction, Cody was a great upperclassman and a great representation of "A Man for Others" and the Jesuit Tradition. Thoughts and prayers with Cody's Family and Friends.

When I was a kid, Cody Davis was something of a heroic figure in our neighborhood. Life was free-wheeling and far less restricted in those days...endless days exploring canals and seawalls...and Cody was a constant. He wasn't just the "cool guy".... he stood up for younger ones who found themselves on the wrong side of a bully, he'd show you a good cast from your reel, and, more personally, dove into the bay, without hesitation, to rescue my dog that had fallen in. Might as well been wearing a cape...
Our paths had not crossed in many years, but the memory of a good man who treated everyone with genuine kindness has, and will, remain.
Rest in Peace, fellow Son of Tampa.
Peace and Blessings to his family.

I mainly knew Cody the young man and tennis player at the old Davis Islands courts where he and Jim played regularly. I was a few years older but he quickly surpassed my game. He would later joke that after he returned from college took the Tampa Yacht Club championship from me, it was only disputed between he and Bill Cantrell for the next couple decades. These last few years it was mainly thru another tennis friend, John Day that I was kept me up with Cody's family and hobbies, boating, diving and tennis. Cody was always special and we will all miss him.

We are deeply saddened by the sudden loss of this wonderful human Cody Davis! I just got to talk to him the other day... he called me young lady! Growing up with Cody and the gang at the Davis Island tennis court was an experience and privilege I wish all children could have! Cody made the world a better place ! RIP Cody! Gone too soon!

I am saddened that one of my childhood tennis buddies has been taken from his wife, daughters and other family and friends to osoon. It seems like only yesterday Cody was displaying his boyish charm and outgoing personality at the old Davis Island Tennis Club when we all were just boys. Playing tennis matches for Cokes and cans of tennis balls, along with an occasional card game, was enough for a close knit group of tennis compades from different cultures and parts of Tampa. Beth, while I'm sure the pain is unbearable, please know that Cody was one of the good guys and, along with you, raised some pretty amazing children, which is his legacy. While lawyers, judges and clients will remember Cody for his excellence as a top-notch lawyer, his family and friends will remember him for much more. Cody was a rennisance man with superb athletic ability who overcame much to achieve so much more. In Jewish culture, one of the greatest compliments a person can receive is to be called a "mensch"-a true human being. Cody Fowler Davis was a mensch and a son, brother (Jim, my thoughts are also with you as you deal with this tragedy) , husband, father, lawyer, and friend whose bright light will be sorely missed. Myra and I send our deepest sympathies. Wolfie.
